What are the key Indian employment laws I need to comply with?
The main laws include the Employees’ Provident Funds Act, Employees’ State Insurance Act, Payment of Gratuity Act, Maternity Benefit Act, Shops & Establishment Acts (state-specific), Payment of Wages Act, and the POSH Act. The four Labour Codes (Wage, Industrial Relations, Social Security, Occupational Safety) are being phased in and will eventually consolidate many of these. We track all of them on your behalf.
What is the POSH Act and do I need to comply?
The Prevention of Sexual Harassment (POSH) Act applies to all organisations with 10 or more employees in India. It requires a written anti-harassment policy, a constituted Internal Committee (IC), annual employee awareness training, and annual filing with the local authority. Non-compliance carries fines and can result in licence cancellation. We draft the policy, support IC constitution, and manage annual filings.
How is gratuity calculated in India?
Gratuity is payable to employees who have completed 5 or more years of continuous service. The formula is: (Last drawn salary × 15/26) × number of completed years of service. The maximum gratuity payable is ₹20 lakhs. We provision for gratuity monthly and manage the calculation and payment at the point of exit.
